Terms of Service

These Terms of Service govern Garrison’s website, business software, customer Portal, and related services. Garrison is operated by BRHND LLC, a California limited liability company (“Garrison,” “we,” “us,” or “our”). Please read these terms before creating an account or purchasing a plan.

Your agreement with Garrison

By accepting these terms, creating an account after being presented with them, or agreeing to an order that incorporates them, you agree to this contract. If you act for a business or other organization, you confirm that you have authority to bind it. In that case, “you” means that organization as well as the individual using the service where the context requires it.

You must be at least 18 and legally able to enter this agreement. Do not create an account or use restricted features if doing so would violate applicable law. Services, payment methods, phone numbers, and integrations may be available only in supported countries or to eligible businesses.

Garrison subscriptions are intended for business and professional use. A customer who accesses a business’s Portal for personal purposes does not become a business subscriber merely by doing so. Your legal status and any mandatory protections depend on the actual relationship, not just the name given to an account.

An order or separate agreement signed by both parties takes precedence where it expressly changes these terms. Our Privacy Policy explains how personal information is handled. Applicable payment or third-party terms may also govern the features you choose to connect.

Accounts and your team

Provide accurate account, business, contact, and billing information and keep it current. Protect your credentials and verification methods, use the security controls available to you, and tell us promptly if you suspect unauthorized access.

Your organization controls the people it invites, the roles it assigns, its connected services, and the information it makes available to customers. You are responsible for authorized users acting for your organization and for removing access when it is no longer appropriate. Do not use another person’s credentials or access an organization without permission.

Workspace owners and authorized administrators may manage business records and other users’ access within their permissions. An employee account is not a personal storage service independent of the organization. Resolve questions about ownership of an organization or its records with the organization’s authorized representatives.

Using the service

While this agreement is in effect, we give you a limited, non-exclusive right to use Garrison for your organization’s lawful business activities and, where invited, to interact with a business through its customer Portal. This is access to a service, not a sale of the underlying software.

Your selected plan, order, feature settings, and applicable usage allowances determine what is available. Where a plan includes unlimited team members, projects, or locations, that does not make communications, storage, AI work, or other metered activity unlimited. Marketing features are part of Garrison plans, subject to the plan’s availability and usage allowances.

You provide the devices, internet connection, and compatible software needed to use Garrison. We may maintain, improve, or change the service. We will give reasonable notice of a material reduction to a purchased service where practicable, unless a faster change is needed for security, legal compliance, or circumstances outside our reasonable control.

Plans, usage, and billing

The price, billing interval, included usage, and applicable add-ons are shown when you order. Amounts are in US dollars unless stated otherwise. A monthly equivalent shown for an annual plan is a comparison figure; the annual amount is charged according to the annual billing arrangement you accept.

Paid subscriptions renew for the same billing interval unless cancelled before renewal. You authorize the payment processor to charge your chosen payment method for the subscription, add-ons, taxes, and usage charges you incur under the disclosed rates. Keep your payment method current. We will notify you of a subscription price change before it applies to your next renewal, with an opportunity to cancel, and obtain any consent the law requires for that change.

Free plans have no subscription charge. Using a free plan does not itself authorize a paid subscription or paid overage. Features may stop when the free allowance is used. Paid plans may incur usage charges beyond their included allowances, as described in the plan and billing controls.

Fuel measures certain AI and automated work. Other activity, including texts, calls, email, document generation, storage, and number rental, may have separate meters. Included allowances follow their stated period. Annual flow allowances may be pooled over the subscription year, while storage is a capacity allowance. A one-time grant is not a recurring refill. Purchased top-ups follow the terms displayed when you purchase them. SMS you send is measured in segments, so a longer message or certain characters can use more than one segment. Multimedia messages have their own rate. Phone-number rental remains a monthly charge even when your Garrison plan is billed annually.

You are responsible for applicable taxes on your purchases, other than taxes on our net income. Tell us promptly if you believe a charge is incorrect. Nothing in these terms removes a refund, credit, or payment-dispute right required by law or granted in your order or a written agreement with us.

Changing or cancelling a plan

A person with billing-management permission can cancel an active paid subscription in the organization’s billing settings. Cancellation stops the next renewal and takes effect at the end of the current paid period. You keep the paid access for that period, subject to these terms. Cancellation does not itself issue a refund; any refund rights under law or your order still apply.

Contact hello@garrison.app if you cannot access the cancellation control or need help with a billing issue. Any disclosed charges already incurred remain payable. A plan change, downgrade, or separate add-on may have different timing, which will be shown when you make the change.

Cancelling a subscription is separate from deleting an organization or its records. It does not cancel agreements, jobs, or invoices between your business and its customers, or subscriptions you hold directly with another provider. Review and manage those arrangements separately.

Your customers and their Portal

Garrison supplies business software. We do not perform the home services, contracting, maintenance, or other work offered by businesses using it. Those businesses are responsible for their licenses, insurance, employees, service descriptions, prices, scheduling commitments, work quality, warranties, and customer agreements.

A customer using the Portal interacts with the business identified in that workspace. Questions about a quote, job, invoice, refund, or service dispute should first go to that business. Garrison does not become a party to an estimate or agreement merely because it was created, shared, signed, or paid through our software.

Portal users must provide accurate information, protect their access links, and access only records they are authorized to see. Portal use alone does not make a customer responsible for the business’s Garrison subscription. Nothing here limits a customer’s non-waivable rights against the business or against Garrison.

Collecting customer payments

Payment processing is provided by third-party processors, including Stripe. A business connecting Stripe must complete the required onboarding and comply with the applicable Stripe Services Agreement and Connected Account Agreement. Processor approval and continued eligibility are not guaranteed.

By enabling payment features, you authorize Garrison to send transaction instructions and relevant account or transaction information to the processor to provide the features you use. You remain responsible for legitimate transactions, accurate amounts, required customer authorizations, receipts, taxes, lawful fee disclosures, refunds, and responding to disputes relating to your goods or services.

Processor and platform fees, where applicable, are disclosed through the relevant payment or account setup. Settlement timing, reserves, chargebacks, and payment restrictions can depend on the processor and payment method. Garrison is not a bank and does not guarantee that a customer will pay or that a transaction cannot later be disputed or reversed.

Calls, texts, and marketing messages

Your business is responsible for the recipients, content, timing, and purpose of the calls, texts, email campaigns, and other communications it sends or configures. Obtain and retain the permissions required by applicable law and provider rules, including prior written consent where required. An uploaded contact, past customer relationship, or publicly available phone number does not by itself establish every permission needed for marketing.

Identify your business accurately, provide required sender and postal information, and include the required unsubscribe or opt-out mechanisms. Honor valid revocations, do-not-contact requests, and applicable do-not-call requirements. Do not bypass a suppression setting, use purchased or harvested contacts without the necessary rights, spoof a sender, or send deceptive or unlawful messages.

Before recording, transcribing, or using an artificial voice in a call, determine the rules that apply to every participant and provide the required notice and consent. Recording settings, templates, and consent tools help you manage communications; they do not replace your responsibility to use them lawfully. Garrison’s own legal duties remain unchanged.

Phone numbers require an eligible paid Garrison plan and are rented separately at the disclosed monthly rate per number. Local and toll-free numbers have different rates; calls and messaging remain subject to the plan’s usage allowances and charges. Availability, registration, verification, message delivery, and call quality depend in part on carriers and other providers. You do not obtain ownership of a phone number by renting it. This does not remove any number-portability rights you have under applicable law. Contact us before releasing a number if you want to keep it with another provider; releasing it can make it unavailable to you.

Do not rely on Garrison for emergency communications. Keep a separate means of contacting emergency services. Internet-based calling may be affected by power, internet, device, or provider failures, and these terms do not promise 911 or emergency-location functionality. This warning does not limit any emergency-service obligations imposed on us or a provider by applicable law.

Documents, signatures, and automated actions

You are responsible for the content and suitability of estimates, agreements, invoices, forms, and other documents you create. Templates are starting points, not legal, accounting, tax, or trade advice. Obtain any professional review your work requires.

When using electronic signatures, confirm each signer’s identity and authority, obtain required consent to electronic records, and provide any disclosures, copies, or alternative signing method required by law. Keep the records your business needs. A signature tool alone does not establish that every document or transaction meets every legal requirement.

Review an automation’s conditions, recipients, permissions, and actions before enabling it. An enabled workflow may send messages, publish material, update records, or use paid services according to your configuration. Monitor its results and turn it off when it is no longer appropriate. You remain responsible for actions you authorize, including actions performed automatically for your organization.

Tony and other AI features

AI features can produce incomplete, inaccurate, outdated, or unsuitable information. Review outputs before relying on them, sharing them with customers, publishing them, or using them to make a business decision. They do not replace qualified professional judgment or your review of the underlying business records.

You must have the rights and permissions needed for prompts, images, recordings, and other material submitted to AI features. Do not use AI to impersonate people deceptively, misrepresent customer experiences, generate deceptive reviews, or infringe someone else’s rights.

Provide any disclosures required when people interact with AI or when you publish AI-generated or altered material. Do not remove a required disclosure or use automated decisions in a way that violates someone’s rights. Your responsibilities do not replace Garrison’s own obligations as a provider.

As between you and Garrison, you keep your rights in your inputs. To the extent we have transferable rights in an output generated for you, we assign those rights to you. This does not guarantee that an output is unique, copyrightable, or free of third-party rights; similar outputs may be produced for others. Third-party material retains its own rights and restrictions.

AI requests may use third-party models or services, as explained in our Privacy Policy. Charges and allowances apply to the work performed, not a guarantee that an output will achieve a particular result.

Your content and business records

You retain your ownership rights in the business records, documents, photos, messages, and other content you or your users provide. You give Garrison a limited right to host, copy, process, transmit, and display that content as needed to provide and secure the service, carry out your instructions, and meet applicable legal duties. We may use service providers for those purposes under appropriate obligations.

You are responsible for the accuracy and lawfulness of your content, the permissions needed to collect or share it, and your instructions to Garrison. Do not submit information you are not entitled to handle. If your intended use requires a separate regulated-data agreement or safeguards, contact us to confirm whether that use can be supported before uploading the data. Do not submit it until any required written agreement and safeguards are in place; a standard account does not establish them.

Use available export and download tools to keep the records your business needs. Account cancellation, content deletion, and legally required retention are different processes. Data handling after closure is described in the Privacy Policy and any applicable written data-processing agreement. These terms do not promise permanent storage or a particular post-closure recovery period.

International customers and personal data

If you have consumer rights under the law that applies to you, including in the European Economic Area or United Kingdom, these terms do not remove them. This includes applicable rights to required service quality, remedies, refunds, and withdrawal from a distance contract. Starting to use Garrison does not, by itself, waive a statutory withdrawal right or replace a consent or acknowledgement required by law.

Where we process personal data on your organization’s instructions, a binding data-processing agreement must be in place when applicable law requires one. Contact hello@garrison.app to arrange the required terms before that processing begins. This Terms page and the Privacy Policy do not by themselves establish an international-transfer safeguard or replace a required data-processing agreement.

Nothing in the ordinary cancellation, access, or storage provisions restricts a non-waivable right to retrieve or transfer your data, switch providers, or request deletion. Any applicable statutory switching rights and agreed data-processing terms take precedence over inconsistent general provisions here.

Confidential information

Each party will take reasonable care to protect the other’s non-public business information that is marked confidential or should reasonably be understood to be confidential. It may be used only to perform this agreement or as otherwise authorized, and shared only with people or service providers who need it for those purposes and are subject to appropriate confidentiality duties.

This obligation does not cover information that is lawfully public, already known without restriction, independently developed, or rightfully obtained from another source. A party may disclose information when legally required and, where permitted, will give reasonable notice so the other party can seek protection. Personal information is also subject to the Privacy Policy and applicable data-protection law.

Acceptable use

Do not use Garrison to:

  • Break the law, defraud or harass anyone, distribute malware, or create unlawful, infringing, discriminatory, or deceptive content.
  • Access another person’s records without authority, probe or defeat access controls, disrupt the service, or evade usage limits, billing, or account restrictions.
  • Send spam, create deceptive reviews or engagement, misrepresent your identity, or manipulate public listings using false business information.
  • Scrape or extract data without authorization, resell access without our agreement, or reverse engineer the service except where applicable law permits it despite this restriction.
  • Use the service for activities prohibited by applicable sanctions, export controls, carrier rules, payment-network rules, or the connected service’s lawful terms.

These restrictions do not prevent honest reviews of Garrison or lawful reports to a regulator, law-enforcement agency, or other authority.

Report suspected abuse or a vulnerability to hello@garrison.app. Do not access other users’ data or disrupt their work while investigating an issue.

Connected services and our software

Connecting a third-party account authorizes the access and actions described by the connection and the features you use. You must have authority to connect that account and comply with its provider’s terms. Providers may change their services, permissions, prices, or availability, affecting what an integration can do. A connection does not mean the provider endorses Garrison.

Garrison and its licensors retain rights in the software, designs, documentation, trademarks, and other material we supply, apart from your content and any rights expressly assigned to you. Do not remove ownership notices or use our branding in a way that suggests an unauthorized partnership.

If you choose to send product feedback, you allow us to use it to improve Garrison without an obligation to pay you. This permission does not give us ownership of your customer records or confidential business information.

Suspension and ending access

We may restrict or suspend access where reasonably necessary to address a material breach, overdue payment, unauthorized use, a security risk, or a legal or provider requirement. Where practical and lawful, we will explain the issue and allow a reasonable opportunity to resolve it. We may act immediately when delay could cause harm or violate the law.

Either party may end this agreement for a material breach that is not corrected within a reasonable period after notice, or immediately if it cannot be corrected. You may stop using the service and cancel as described above. If we permanently end a prepaid service for our convenience, we will refund the unused prepaid subscription portion for that service.

Ending access does not erase accrued payment obligations or rights that arose before termination. Content rights, confidentiality, payment obligations, liability provisions, and other provisions intended to continue will survive to the extent needed to give them effect. Request or export needed records before closing the organization; access may no longer be available afterward.

Service expectations

We will use reasonable care in providing Garrison. Except for commitments expressly made in a written agreement and rights that cannot lawfully be excluded, the service is provided as available. We do not warrant uninterrupted or error-free operation, compatibility with every device or third-party service, or a particular business, marketing, financial, or search-ranking result.

To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not exclude a guarantee or remedy that applicable law requires. Free, trial, or experimental features may change and should not be your sole means of keeping essential records or performing safety-critical work.

Limits on liability

To the extent permitted by law, neither party is liable to the other under this agreement for indirect or consequential loss, lost profits, lost business opportunities, or loss of goodwill, even if advised that such loss was possible.

To the extent permitted by law, each party’s total liability arising from this agreement is limited to the greater of US $100 or the fees paid or payable to Garrison for the affected organization’s service during the 12 months before the event giving rise to the claim. Payments your customers make to your business are not Garrison subscription fees for this calculation.

These limits do not exclude or limit liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not allow a contract to exclude or limit. They do not excuse your obligation to pay valid fees already incurred. Consumer rights and remedies that cannot be waived remain available. These provisions do not restrict an individual’s non-waivable data-protection rights, a regulator’s powers, or protections under a binding international data-transfer instrument that cannot be limited by this agreement.

Third-party claims involving your business

If you use Garrison for a business, you will defend and indemnify Garrison against a third party’s claim arising from your unlawful customer content or communications, your infringement of that party’s rights, or the goods or services your business provides. This applies only to the extent the claim results from your actions and does not cover Garrison’s own breach, negligence, or misconduct.

We must promptly notify you of the claim, provide reasonable cooperation at your expense, and allow you to manage the defense with qualified counsel. You may not agree to a settlement that admits fault for us or imposes an obligation on us without our written consent. This section does not impose business indemnification duties on a customer merely using a business’s Portal for personal purposes.

Changes, notices, and disputes

We may update these terms as the service or legal requirements change. We will update the date and give notice of material changes through the account or contact details available to us before they apply, unless a sooner change is required for law or urgent security reasons. Where the law requires renewed consent, we will seek it. Changes will not apply retroactively to an existing dispute.

If you do not accept a material change, you may stop using the affected service and cancel before the change takes effect. We may send account, billing, security, and legal notices electronically using your account details. Keep those details current; marketing preferences do not prevent necessary service notices.

California law governs this agreement, without applying conflict-of-law rules that would displace it, except where mandatory law gives you other protections. You may contact us to try to resolve a concern, but doing so is not a condition of bringing a claim. These terms do not require arbitration or waive your right to bring an eligible claim in a court with proper jurisdiction.

If you are a consumer, this choice of law does not deprive you of mandatory protections under the law of your habitual residence where those protections apply. You retain any right to bring proceedings in your home courts, and any protection against being sued elsewhere, that applicable law gives you.

If a provision is unenforceable, the rest of the agreement remains effective to the extent permitted by law. Not enforcing a provision once is not a waiver of it. These terms and any applicable order or signed agreement form the agreement about Garrison; unrelated consulting or agency engagements are governed by their own agreements.
